Legal Methods II

LAW 395

Legal Methods II will continue to improve essay and multiple-choice question fluency and enhance comprehension of first year subjects other than those used in Legal Methods I. Students will continue to complete practice essay questions and practice multiple-choice tests. Students will receive feedback on the exercises they complete in class. All required assignments will be completed in class. Grading: Legal Methods I & II will be graded on a Pass/No Credit/Fail basis. A Pass will be awarded to students who perform work at the equivalent of a 2.5 numerical grade or above. A No Credit will be awarded to students who perform work at the equivalent of a 1.8 to 2.4 numerical grade. A Fail will be awarded to students who performed work at the equivalent of a 1.7 numerical grade or below. Legal Methods II will be a graduation requirement for student who receive a No Credit or Fail in Legal Methods I.

Legal Policy Clinic Seminar

Legal Policy Clinic consists of a series of readings on various non-litigation policy analysis and strategies. Students are required to write on legal topics of his/her choice: (1) Letter to the Editor; (1) Petition for review; (2) Petition to publish or depublish an appellate opinion; (3) Amicus Curiae brief; or (4) Community educational plan with course teaching materials. One of the major goals of this course is to instill in law students a desire and ability to engage in a lifetime of pro bono legal public policy analysis and service.

Legal Writing II

LAW 107

Legal Writing II continues and reinforces the teachings of Legal Writing I, but the focus shifts to persuasive writing. Students will also participate in an oral advocacy competition at the end of the semester to showcase all that they have learned.

Lesbian Gay Bisexual Transgender Parenting Legal Issues

This survey course will focus on the legal issues surrounding gay and lesbian parenting, contrasting the approach of Northern European nations with the prevailing approaches in the United States. The course will address the legal issues faced by the LGBT community with particular emphasis on children of LGBT couples.

Local Government Law

LAW 550

Local governments are cities, counties, special districts, or public authorities. Some types of special districts are school districts, flood control districts, and water districts. Public authorities are government entities that usually perform a single function. For example, fire protection is provided to many Orange County cities by the Orange County Fire Authority. Most basic government services and functions, including police and fire protection, education from kindergarten through community college, sanitation and health services, water, flood control, transportation, and land use regulation are provided by local governments. Local governments license businesses and tax us and our property. Local government permits are required for many activities. Because of the pervasive impact of local governments on our daily lives, you are likely to represent people involved in litigation with local governments or you might have a local government as a client (many local governments hire private law firms rather than a government lawyer). However, you will discover that the law you learned in most of your courses might operates in special ways when a local government is involved. There are special rules of tort law and contract law for local government actions. Many courses focus on rules for private parties and skip the special rules for local governments. Local Government Law is a survey course designed to prepare you to deal with the types of local government issues often encountered in private practice or as a local government lawyer. The course begins with a study of the types of local governments and their powers. We will also examine the legal relationships of local governments with each other and with the state and national government. These concepts are the foundation of all issues involving local government law. Two other important topics we will study are the revenue powers and legal liability of local governments. You will be introduced to other selected topics such as local government employment law, local government contracting, land use control, and researching local government law. The course is designed to teach the basics of local government law for any state, but many of the cases and illustrations will focus on California law and current events. All course materials, including the casebook, will be provided without charge on CD-ROM, on TWEN, or in class handouts. Mediation

LAW 960

A lecture and clinical simulation course covering the principles and clinical skills used in mediation. The course also offers a comparative overview of the field of alternative dispute resolution, and in particular the practical differences between using arbitration or mediation in resolving disputes. Simulations and other exercises are conducted to develop practice skills and to explore the public policy and legal issues that arise.
